Whether you can work while an asylum claim is pending differs sharply across the UK, US, Canada and the EU. This guide sets out the practical rules. It complements our earlier work during asylum article with focus on jurisdictional differences and practical navigation of the frameworks.[1]
Work rights vary dramatically — Canada offers immediate open work permits, UK restricts to Shortage Occupation List after 12 months, US EAD after 180 days, EU 2-9 months varying by member state. Understanding your jurisdiction's specific rules is essential for daily survival and legal compliance.

UK Work Rights
UK asylum seekers cannot work for the first 12 months of their claim. After 12 months without decision, permission-to-work application possible — but restricted to Shortage Occupation List.[2]
First 12 Months
No work permitted. Section 95 support — £49.18/week adult + accommodation. Volunteering with charities permitted (unpaid).
After 12 Months
Apply to Home Office for permission (Form IPT). Restricted to Immigration Salary List (formerly SOL). Few asylum seekers realistically qualify.
Lift the Ban
Advocacy for immediate work rights since 2018. Refugee Action, JCWI, Church Action on Poverty campaign. Not enacted through 2025-2026.[3]
US Work Rights
US asylum seekers can apply for Employment Authorization Document (EAD) 150 days post-I-589 filing. Work permitted 180 days post-filing.[4]
Process
- File Form I-589 (start 180-day clock).
- Wait 150 days.
- File Form I-765 (EAD, category c(8)).
- Fee — $520 (2024).
- Wait ~90 days for EAD.
- Effective 180 days from filing.
- Renewal — 180 days before expiration.
Restrictions
Applicant delay pauses 180-day clock. No federal cash assistance during first 180 days. Some state programmes (NY, CA, MA) offer interim support.
Canada Work Rights
Canadian asylum claimants apply for open work permit upon claim acknowledgement.[5]
- Claim acknowledged.
- File work permit application through IRCC.
- Medical examination required.
- Permit typically 3-6 months.
- Full work rights — any employer.
EU Work Rights
EU Reception Conditions Directive 2013/33/EU Article 15 requires work access within 9 months maximum. Member state variation:[6]
| Country | Work permitted from |
|---|---|
| Germany | 3 months (some restrictions) |
| France | 6 months (with permit) |
| Netherlands | 6 months (24 weeks/yr max) |
| Sweden | Immediate (AT-UND) |
| Spain | 6 months |
| Italy | 2 months |
| Ireland | 6 months |
| Belgium | 4 months |
Volunteering
Volunteering with charities is generally permitted across jurisdictions.[7]
No payment received. Registered charity or social enterprise. Reasonable expense reimbursement only. No competition with paid employees.
Benefits — mental health, references, language skills, integration for naturalisation.
Informal Work Risks
Working without authorisation carries substantial risks.[8]
Removal risk — unauthorised work triggers enforcement. Support withdrawal. Credibility damage. Criminal exposure — employer prosecution. Exploitation — informal employment lower paid, unsafe. Future naturalisation affected — good character requirements.
Study Rights
Study rights parallel work rights.[9]
UK — can study; higher education funding restricted. US — can study; ESL programmes widely available. Canada — study permit available. EU — generally permitted.
Post-Grant Work Rights
Once asylum is granted, full work rights apply immediately in all jurisdictions. See our post-refugee-status rights article.
Comparison Table
| Country | Work eligibility | Restrictions |
|---|---|---|
| UK | After 12 months | Immigration Salary List only |
| US | 180 days post-I-589 | EAD required (I-765) |
| Canada | Immediate on claim | Open work permit |
| Germany | 3 months | Vorrangprüfung in some regions |
| France | 6 months | ADPA authorisation |
| Netherlands | 6 months | 24 weeks/year maximum |
| Sweden | Immediate | AT-UND exemption |
Work rights during asylum vary dramatically — Canada immediate, US 180 days, UK 12 months (restricted), EU 2-9 months. Understanding your specific rules matters both for survival and compliance. Unauthorised work is not worth the risks.
