Appeal timelines and steps differ across UK, US, Canadian and EU jurisdictions. This guide walks applicants and representatives through each of them. It complements our earlier appeal procedures article with focus on procedural depth — exactly what forms to file, what deadlines apply, what documents to prepare, and what happens at each stage.[1]

Appeals succeed at meaningful rates across all four systems — around 50% at UK First-tier Tribunal, comparable rates elsewhere. Understanding the procedural framework is essential for making that success achievable.

UK Appeal Procedure — Detailed

1. Notice of Decision

UK Home Office refusal issued as "Reasons for Refusal Letter" (RFRL). Notice contains appeal rights and deadline. Read carefully within 24 hours of receipt.[2]

2. Notice of Appeal — Form IAFT-1

UK appeals lodged using Form IAFT-1 (First-tier Tribunal Immigration and Asylum Chamber Notice of Appeal). Key fields:

Personal details. Home Office reference. Type of decision being appealed. Grounds of appeal (specific). Language for hearing. Representation details.

3. Fee

Oral hearing — £80. Paper determination — £140. Fee remission available on means test. Application via EX160 form.

4. Standard Directions

Tribunal issues standard directions typically requiring:

Bundle preparation — 14 days before hearing. Skeleton argument — 7 days before. Witness attendance confirmation. Expert reports service.

5. Appellant's Bundle

Bundle content typically includes:

Witness statement (updated). Supporting witness statements. Country expert report. Medico-legal reports. Country evidence — UN, HRW, Amnesty, CPIN. Original documents with translations. Sur place evidence. Skeleton argument.

6. Hearing

Hearing at First-tier Tribunal IAC hearing centre. Duration 3-6 hours. Structure — examination-in-chief, cross-examination, re-examination, closing submissions.

7. Determination

Reserved decision. 2-8 weeks typical. Written determination sets out findings, reasoning, and outcome.

8. Permission to Appeal (Upper Tribunal)

14 days from determination. First to First-tier for permission; if refused, to Upper Tribunal directly. Error of law grounds required.

US Appeal Procedure — Detailed

1. From EOIR to BIA

US Immigration Judge decision followed by Board of Immigration Appeals appeal.[3]

Form EOIR-26 — Notice of Appeal filed 30 days. Fee — $110. Briefing schedule — 21 days from transcript receipt. BIA decision — 8-24 months typical.

2. Petition for Review to Circuit Court

Federal circuit court review of BIA final orders:

30 days to file petition. No new evidence — record review only. Standard — substantial evidence (fact); de novo (law). Decision — 12-24 months.

3. Motion to Reopen

Where new evidence emerges — 90-day deadline with limited exceptions. See our fresh claim article.

Canada Appeal Procedure — Detailed

1. RAD Appeal

15 days from RPD refusal to file Notice of Appeal. 30 days to perfect appeal (Appellant's Record). Written submissions — usually. RAD decision — 12-24 months typical.

2. Federal Court Judicial Review

15 days for leave application. Leave granted or denied. Judicial review if leave granted.

EU Appeal Framework

EU Procedures Directive 2013/32/EU Article 46 requires effective remedy. Implementation varies by member state.[4]

Country Court Typical deadline
Germany Verwaltungsgericht 2 weeks; 1 week accelerated
France CNDA 1 month
Netherlands Rechtbank 4 weeks; 1 week accelerated
Italy Tribunale 30 days
Sweden Migrationsdomstol 3 weeks
Spain CNCA 2 months
Table 1: EU appeal deadlines by member state.

Grounds of Appeal — Common

Strong appeals typically raise multiple grounds:[5]

Credibility findings irrational — HK v SSHD [2006] EWCA Civ 1037. Country evidence wrongly assessed. Convention grounds wrongly applied. Internal relocation analysis flawed — Januzi/AH (Sudan). State protection wrongly found adequate — Horvath. Expert evidence not engaged with — Mibanga. Procedural unfairness. Article 8 ECHR not considered.

New Evidence on Appeal

Rules vary on new evidence:[6]

UK — new evidence admissible; Devaseelan principle applies weight. US BIA — record review only; new evidence via motion to reopen. Canada RAD — new evidence with certain restrictions. EU — varies by member state; often more restrictive at higher levels.

Timeline Planning

Working backwards from hearing:

  1. Day of refusal — analyse letter, contact representative.
  2. Days 1-7 — grounds of appeal drafted.
  3. Days 7-14 — Notice of Appeal filed with grounds.
  4. Weeks 2-8 — evidence gathering.
  5. Weeks 8-16 — country expert report commissioned.
  6. 4 weeks before hearing — bundle finalisation.
  7. 2 weeks before — skeleton argument.
  8. 1 week before — witness preparation.
  9. Day of hearing — attend.

Fees and Legal Aid

UK — LASPO Schedule 1 legal aid for in-scope cases; ExceptionalCaseFunding for others. US — no federal legal aid; pro bono networks (NIJC, CLINIC, HIAS). Canada — provincial legal aid (Ontario, BC, Quebec). EU — varies; Germany, France, Netherlands have strong systems.

See our free legal help directory.

Winning Strategy

  1. Meet the deadline — first priority.
  2. Get represented — dramatic difference.
  3. Analyse refusal letter — every point addressed.
  4. Update country evidence — post-refusal developments.
  5. Commission expert reports — country expert, medico-legal.
  6. Prepare witness statement addendum.
  7. Address credibility findings directly.
  8. Prepare witnesses thoroughly.
  9. Attend hearing prepared.
  10. Consider Article 8 ECHR parallel claim.

The appeal procedure is where cases are frequently won. Meet the deadline, get representation, update evidence, address refusal points. Around half of UK appeals succeed — the framework is genuinely favourable to strong cases.

Conclusion

The asylum appeal procedure follows structured steps across all major jurisdictions. UK — 14 days IAFT-1, £80 fee, First-tier Tribunal hearing, reserved determination. US — 30 days EOIR-26 to BIA, then federal circuit review. Canada — 15 days RAD, then Federal Court leave. EU — varies by member state under Procedures Directive framework. Around 50% UK success rate makes appeals critically important. See our companion timelines article, complete appeal guide, and fresh claim article.
