Country Expert — Human Rights, Political Situation & Asylum Cases
Country Expert — United States, Canada: Human Rights, Political Situation & Asylum Cases
Expert at The Human Rights Experts, an international expert witness organisation.
We provide expert witness reports for asylum cases worldwide, covering human rights violations, political persecution, and systemic oppression. Our reports are trusted by lawyers, courts, and immigration authorities, in full compliance with procedural standards and tribunal requirements in the UK (CPR Part 35, Upper Tribunal PD, First-tier Tribunal IAC PD), USA (Federal Rules of Evidence), Canada, and the EU.
I provide expert analysis on all five Refugee Convention grounds — political opinion, religion, ethnicity, membership of a particular social group (including LGBT and gender-based cases), and nationality — with a focus on the following countries:
United States of America: The United States, while maintaining a constitutional framework of rights protections, faces substantial and documented human rights challenges. Systemic racial discrimination permeates the criminal justice system, with African American and Latino men disproportionately subjected to police violence, mass incarceration, and harsher sentencing. Immigration enforcement has involved the detention of asylum seekers in conditions criticised by international monitors, family separation practices, and expedited removal processes that limit access to legal representation. Indigenous Native American communities face persistent disparities in health, education, and housing, with ongoing land rights disputes and environmental justice concerns, particularly regarding pipeline and extractive projects on or near tribal lands. Gender-based violence affects an estimated one in three women, with barriers to justice exacerbated by race and economic status. LGBT rights face an increasingly fragmented legal landscape, with some states enacting restrictions on transgender healthcare, education accommodations, and anti-discrimination protections, while others maintain comprehensive protections. Religious minorities, particularly Muslim and Jewish communities, face elevated levels of hate crimes and community-based discrimination.
Canada: Canada confronts significant human rights challenges despite its international reputation, most critically regarding the treatment of Indigenous First Nations, Metis, and Inuit peoples. The legacy of the residential school system, the ongoing crisis of missing and murdered Indigenous women and girls, and persistent disparities in access to clean water, healthcare, and housing on reserves constitute systemic patterns of discrimination. Immigration detention, including the detention of children, has drawn criticism from UN bodies. Asylum seekers arriving through the Safe Third Country Agreement face restrictions that limit protection options. Religious minorities face increasing hate crime rates, with documented incidents targeting Muslim, Jewish, and Sikh communities. LGBT individuals benefit from comprehensive federal protections, including marriage equality and conversion therapy bans, but face discrimination in certain provinces and within specific institutional settings. Gender-based violence, particularly affecting Indigenous women and girls, remains a national crisis despite inquiries and recommendations. Political activists, particularly Indigenous land defenders, have faced criminal prosecution and surveillance in the context of pipeline and resource extraction conflicts.
