Country Expert — Human Rights, Political Situation & Asylum Cases
Comoros, Madagascar & Mauritius Expert — Human Rights, Political Situation & Asylum Cases
Expert at The Human Rights Experts, an international expert witness organisation.
We provide expert witness reports for asylum cases worldwide, covering human rights violations, political persecution, and systemic oppression. Our reports are trusted by lawyers, courts, and immigration authorities, in full compliance with procedural standards and tribunal requirements in the UK (CPR Part 35, Upper Tribunal PD, First-tier Tribunal IAC PD), USA (Federal Rules of Evidence), Canada, and the EU.
I provide expert analysis on all five Refugee Convention grounds — political opinion, religion, ethnicity, membership of a particular social group (including LGBT and gender-based cases), and nationality — with a focus on the following countries:
Comoros: The Union of the Comoros has a turbulent political history shaped by over twenty coups or attempted coups since independence, reflecting deep-seated inter-island rivalries and the fragility of democratic institutions. The consolidation of presidential authority through referenda and constitutional amendments has marginalized political opposition, with dissenters facing imprisonment and the confiscation of assets. The island of Mayotte, administered by France, remains a source of political and social tension, with Comorians attempting to reach it by sea in dangerous crossings that have caused thousands of deaths, and those who arrive face detention and deportation. Women in the Comoros navigate a complex intersection of Islamic family law and customary practices, facing constraints on inheritance, divorce rights, and economic independence, alongside domestic violence that is rarely reported or prosecuted. Same-sex conduct is criminalized under Article 318 of the Penal Code with imprisonment, and LGBT individuals face total invisibility in public life and severe social consequences if their identity becomes known.
Madagascar: Madagascar's governance challenges are rooted in a political culture of elite competition that bypasses democratic processes, with successive leaders coming to power through military backing or popular uprisings rather than orderly constitutional transitions. The security forces, particularly the gendarmerie in rural areas, have been implicated in extrajudicial killings, arbitrary detention, and the disproportionate use of force against cattle rustling suspects and community vigilante targets. Ethnic and caste-based hierarchies persist in Malagasy society, with the descendants of historically enslaved groups facing ongoing discrimination particularly in highland regions. The exploitation of women and girls through trafficking and early marriage is exacerbated by poverty and the collapse of rural livelihoods. While adult same-sex relations are not explicitly criminalized, a provision against "inciting debauchery" among minors has been applied in ways that target sexual minorities, and broader social attitudes towards LGBT individuals remain hostile.
Mauritius: Mauritius is a multi-ethnic parliamentary democracy that generally upholds the rule of law, but human rights concerns include the treatment of migrant workers in the textile and manufacturing sectors, who face exploitation, wage theft, and unsafe working conditions. The Creole community, descendants of enslaved persons, experiences socioeconomic marginalization relative to the Indo-Mauritian majority and the Franco-Mauritian economic elite. Women face domestic violence and sexual harassment, with cultural norms in some communities discouraging formal complaints. Same-sex conduct was decriminalized in 2023 following a court ruling, but social attitudes, influenced by conservative religious groups across the Hindu, Muslim, and Christian communities, remain broadly unsympathetic, and LGBT individuals continue to face discrimination in daily life.
