Country Expert — Human Rights, Political Situation & Asylum Cases
Country Expert — Cuba, Jamaica: Human Rights, Political Situation & Asylum Cases
Expert at The Human Rights Experts, an international expert witness organisation.
We provide expert witness reports for asylum cases worldwide, covering human rights violations, political persecution, and systemic oppression. Our reports are trusted by lawyers, courts, and immigration authorities, in full compliance with procedural standards and tribunal requirements in the UK (CPR Part 35, Upper Tribunal PD, First-tier Tribunal IAC PD), USA (Federal Rules of Evidence), Canada, and the EU.
I provide expert analysis on all five Refugee Convention grounds — political opinion, religion, ethnicity, membership of a particular social group (including LGBT and gender-based cases), and nationality — with a focus on the following countries:
Cuba: Cuba maintains a one-party communist state in which all political opposition, independent media, and autonomous civil society activity are criminalised. The July 2021 mass protests — the largest demonstrations since the 1959 revolution — triggered a sweeping crackdown in which over 1,500 individuals were detained, with documented cases of enforced disappearance, torture in detention, and summary trials resulting in sentences of up to 30 years for peaceful protesters, including minors. The San Isidro Movement and other independent artistic and activist collectives face constant surveillance, house arrest, and physical assault by state security agents and rapid-response mobs. Independent journalists operating on platforms such as 14ymedio and El Toque face criminal prosecution under vaguely defined charges including "contempt" and "enemy propaganda." Religious communities, while permitted limited freedom of worship, face infiltration and monitoring by state security; unregistered churches and new religious movements face closure and confiscation of property. While the 2022 Family Code introduced same-sex marriage, LGBT individuals continue to face police harassment, employment discrimination, and social stigma, with the legal reform not translating into meaningful cultural change. Economic collapse, shortages of food and medicine, and power blackouts have driven the largest wave of Cuban emigration in history, with hundreds of thousands departing through irregular channels.
Jamaica: Jamaica confronts a deeply embedded culture of violence driven by the intersection of political tribalism, gang warfare, and socioeconomic deprivation. Inner-city communities in Kingston, Spanish Town, and Montego Bay are controlled by dons and gang networks that exercise quasi-governmental authority through extortion, forced labour, and sexual coercion. Security force operations in these areas have involved documented extrajudicial killings, with accountability mechanisms failing to deliver justice. Jamaica is widely recognised as one of the most dangerous countries in the world for LGBT individuals, with colonial-era buggery laws carrying sentences of up to ten years of hard labour. Homophobic violence, including murder, mob attacks, corrective rape, and displacement from family homes and communities, is pervasive and normalised. Transgender individuals face particular vulnerability, with virtually no access to healthcare, identity documentation, or safe employment. Gender-based violence, including domestic abuse, sexual assault, and intimate partner killings, is endemic, with deeply patriarchal social norms inhibiting reporting and prosecution. Religious minorities face social exclusion in a society dominated by conservative Christian denominations whose influence reinforces homophobic and patriarchal attitudes.
