Country Expert — Human Rights, Political Situation & Asylum Cases
Country Expert — Guatemala, Belize, Panama: Human Rights, Political Situation & Asylum Cases
Expert at The Human Rights Experts, an international expert witness organisation.
We provide expert witness reports for asylum cases worldwide, covering human rights violations, political persecution, and systemic oppression. Our reports are trusted by lawyers, courts, and immigration authorities, in full compliance with procedural standards and tribunal requirements in the UK (CPR Part 35, Upper Tribunal PD, First-tier Tribunal IAC PD), USA (Federal Rules of Evidence), Canada, and the EU.
I provide expert analysis on all five Refugee Convention grounds — political opinion, religion, ethnicity, membership of a particular social group (including LGBT and gender-based cases), and nationality — with a focus on the following countries:
Guatemala: Guatemala remains one of the most dangerous countries in Latin America for human rights defenders, indigenous leaders, and political opponents of entrenched corrupt networks. The Maya indigenous majority, comprising over 40 percent of the population, faces systemic racism in every sphere of public life, from education and healthcare to employment and justice. Land rights defenders are routinely subjected to fabricated criminal charges under anti-terrorism statutes, lengthy pre-trial detention, and targeted violence, with impunity rates exceeding 95 percent. Political interference in the judiciary has reached critical levels, with judges and prosecutors who pursued corruption cases forced into exile. Gang violence and organised crime in Guatemala City and secondary cities drive internal and cross-border displacement. Femicide is pervasive, with indigenous women facing intersecting discrimination based on gender, ethnicity, and poverty. LGBT individuals face extreme social exclusion, with hate crimes against transgender persons rarely investigated and customary justice systems in indigenous communities sometimes imposing additional punitive measures.
Belize: Belize confronts significant security challenges from gang violence concentrated in Belize City's southside, drug trafficking routes linking Central and South American cartels, and increasing youth involvement in organised crime. The Maya and Garifuna indigenous communities face unresolved land tenure disputes, with the government failing to implement Supreme Court rulings recognising indigenous land rights. Political opposition figures and journalists face intimidation in a small society where political patronage controls economic opportunity. Gender-based violence, including sexual assault and domestic abuse, is widespread, with cultural normalisation of violence and under-resourced support services. LGBT individuals face criminalisation under Section 53 of the Criminal Code despite a constitutional challenge, and encounter pervasive social hostility, including in schools and workplaces. Religious minorities outside the dominant Catholic and evangelical framework face subtle marginalisation. The prison system suffers severe overcrowding and conditions that amount to cruel treatment.
Panama: Panama, despite its relative economic prosperity, faces stark inequality that disproportionately affects indigenous Ngabe-Bugle, Embera-Wounaan, and Guna communities, who live in extreme poverty with limited access to healthcare, education, and clean water. The Darien Gap has become the world's most heavily transited irregular migration corridor, with hundreds of thousands of individuals from South America, the Caribbean, Africa, and Asia crossing annually and facing robbery, sexual violence, and death during the passage. Environmental and indigenous rights defenders opposing hydroelectric dams and mining projects face criminalisation and threats. Gender-based violence is widespread, with femicide convictions remaining low despite legislative reforms. LGBT individuals encounter discrimination in employment and housing, with transgender persons particularly vulnerable to violence and police harassment. Political corruption and the influence of narcotrafficking on state institutions undermine the rule of law, particularly in border and rural regions.
