Country Expert — Human Rights, Political Situation & Asylum Cases
Country Expert — Haiti, Dominican Republic: Human Rights, Political Situation & Asylum Cases
Expert at The Human Rights Experts, an international expert witness organisation.
We provide expert witness reports for asylum cases worldwide, covering human rights violations, political persecution, and systemic oppression. Our reports are trusted by lawyers, courts, and immigration authorities, in full compliance with procedural standards and tribunal requirements in the UK (CPR Part 35, Upper Tribunal PD, First-tier Tribunal IAC PD), USA (Federal Rules of Evidence), Canada, and the EU.
I provide expert analysis on all five Refugee Convention grounds — political opinion, religion, ethnicity, membership of a particular social group (including LGBT and gender-based cases), and nationality — with a focus on the following countries:
Haiti: Haiti is experiencing a state collapse unprecedented in the Western Hemisphere, with armed gangs controlling an estimated 80 percent of the capital Port-au-Prince and extending their territorial reach into previously stable provincial areas. The absence of a functioning government, elected parliament, or operational judiciary has created conditions of total lawlessness in which armed groups carry out mass killings, kidnappings, and systematic sexual violence with complete impunity. Sexual violence, including gang rape, is used strategically as a weapon of territorial control and intimidation, with women and girls disproportionately targeted. Political actors and civil society leaders who attempt to organise governance solutions face assassination and intimidation from gangs allied with political elites. Vodou practitioners and Protestant religious minorities face periodic targeted attacks and social persecution. LGBT individuals encounter extreme social hostility, including mob violence, in a context where no legal protections exist and community-level enforcement of heteronormative codes is often violent. Ethnic discrimination affects restavek child domestic workers, who face conditions amounting to modern slavery. The complete collapse of healthcare, education, and food security systems has created a humanitarian catastrophe driving mass displacement by sea and overland through the Dominican Republic.
Dominican Republic: The Dominican Republic faces severe human rights challenges, most critically regarding the treatment of Haitian migrants and Dominicans of Haitian descent, who are subjected to mass deportations, racial profiling, and systematic denial of nationality and documentation. A 2013 Constitutional Court ruling retroactively stripped citizenship from hundreds of thousands of Dominicans of Haitian descent, creating one of the largest statelessness crises in the Americas. Police and military operations in border areas and batey communities involve documented abuses, including arbitrary detention, beatings, and separation of families during deportation raids. Gender-based violence, including femicide and sexual assault, is pervasive, with limited access to justice particularly for women in rural and marginalized communities. LGBT individuals face widespread social discrimination, violence, and exclusion, with no anti-discrimination legislation or recognition of same-sex relationships. Religious minorities, particularly Vodou practitioners associated with Haitian culture, face social stigma and discrimination. Political opposition figures and journalists investigating corruption or migration policy face threats and legal harassment. Security forces operate with significant impunity, particularly in anti-crime operations in marginalised urban areas.
