Asylum in UK vs US vs Canada: Key Differences Explained

This article compares asylum UK US Canada — the three largest English-speaking destination systems for refugees. Each operates under the 1951 Refugee Convention but with different procedures, timelines, support structures, post-grant rights, and grant rates. Choosing between them, where possible, has consequences. For most applicants, jurisdiction is determined by where they arrive — but understanding the differences shapes the case strategy.[1]

The three systems share Convention framework but diverge dramatically in implementation. The UK is the most procedurally structured; the US is the most adversarial; Canada is the most welcoming on grant rates and integration support.

UK Asylum System

Structure

UK asylum is administered by the Home Office. Initial application via screening interview and substantive interview. Decision by Home Office caseworker. Appeal to First-tier Tribunal (Immigration and Asylum Chamber). Further appeal to Upper Tribunal IAC.[2]

Procedure

  1. Claim — at port of entry or post-arrival.
  2. Screening interview — initial details.
  3. Substantive interview — main account; 3-6 hours.
  4. Decision — typically 6-15 months post-interview.
  5. Appeal — 14 days; First-tier Tribunal hearing.
  6. Refugee status — 5 years' leave; CTD.
  7. ILR — after 5 years.
  8. Citizenship — 12 months after ILR.

Strengths

  • Free legal aid available.
  • Full NHS access from claim.
  • Decent appeal rate at FtT.
  • Section 95 support during processing.
  • Family reunion straightforward.

Weaknesses

  • No work for first 12 months.
  • Dispersal accommodation outside London.
  • 5-year refugee leave (since NABA 2022) less stable than pre-2022 ILR.
  • Long initial waits.

US Asylum System

Structure

US asylum has two routes — affirmative (USCIS asylum officer) and defensive (EOIR Immigration Court). One-year filing deadline applies (with exceptions). See our one-year deadline article.[3]

Procedure

  1. Form I-589 — file within one year of arrival (with exceptions).
  2. Biometrics — fingerprinting appointment.
  3. EAD eligibility — 180 days post-filing.
  4. Interview (affirmative) or merits hearing (defensive).
  5. Decision — 3-4 years typical.
  6. Appeal — BIA → federal circuit.
  7. I-485 adjustment — to LPR after 1 year of asylum.
  8. Citizenship — 5 years after LPR = 6 years post-asylum.

Strengths

  • EAD available 180 days post-filing — work authorisation.
  • Adjustment to LPR after 1 year.
  • Refugee Cash Assistance 8 months federal.
  • Strong pro bono network.

Weaknesses

  • One-year filing deadline traps many.
  • No federal asylum support; community/family dependent.
  • Adversarial defensive system with ICE counsel.
  • Matter of A-B- restrictions on PSG.
  • Lengthy 3-4 year processing.
  • Detention risk for those crossing borders.

Canada Asylum System

Structure

Canadian asylum processed by Immigration, Refugees and Citizenship Canada (IRCC) / Canada Border Services Agency (CBSA) initially, with merits hearing at the Immigration and Refugee Board (IRB) Refugee Protection Division (RPD). Appeals to Refugee Appeal Division (RAD); judicial review at Federal Court.[4]

Procedure

  1. Claim — at port of entry or inland.
  2. Eligibility interview — determine RPD referral.
  3. Basis of Claim (BOC) form — 15 days from referral.
  4. RPD hearing — 6-18 months.
  5. Decision — at hearing or reserved.
  6. Appeal — RAD within 15 days.
  7. PR application — within 180 days of grant.
  8. Citizenship — 1,095 days physical presence in 5 years (~3 years post-PR = ~4 years post-grant).

Strengths

  • Immediate open work permit on claim acknowledgement.
  • IFHP healthcare from claim.
  • Inquisitorial (non-adversarial) RPD process.
  • Provincial legal aid available.
  • High grant rates (~74% nationally).
  • Permanent residence direct on grant.
  • Shortest path to citizenship (~4 years total).

Weaknesses

  • Safe Third Country Agreement with US limits border claims.
  • Provincial variation in social assistance.
  • Quebec has distinct system (Quebec selection).
  • Post-2023 backlog growth.

Which System Should Apply?

For most applicants, jurisdiction is fixed by arrival location. Where choice exists, factors include the following.[5]

Factor Preferred system
Highest grant rates Canada
Fastest to permanent status Canada
Free legal aid UK or Canada
Free healthcare UK or Canada
Right to work fastest Canada (immediate)
PSG (women, gangs) cases Canada or UK
LGBTQ+ cases UK, Canada
Family already in country Where family is
Language ability Match to English/French capacity
Table 2: Selection factors among UK/US/Canada systems.

Safe Third Country Agreements

The US-Canada Safe Third Country Agreement (STCA) prevents most claimants who entered Canada from the US from making an inland or land-border claim. Exceptions include unaccompanied minors, family with status, public interest exception. The "loophole" of irregular crossings was closed in March 2023 — the Additional Protocol extended STCA to the entire Canada-US border.[6]

The choice between UK, US, and Canadian asylum is rarely available — most applicants present where they arrive. Where choice exists, Canada offers fastest path to permanent status, highest grant rates, and strongest support. UK offers free legal aid and NHS. US offers work authorisation early but no support and long waits.

Conclusion

Comparing asylum UK US Canada reveals three different systems implementing the same Convention framework. UK provides structured procedure with legal aid and NHS. US adversarial system with limited support but adjustment of status. Canada offers highest grants, fastest path to PR, and strongest integration support. For most applicants, the system is fixed by arrival; for some, choice exists and matters. See our companion rights while waiting guide, post-status guide, and full Asylum Guide.
